Guaranteed Payment .Buying to rent out Flats

If you rent out a furnished flat for a limited period of time, you do not run the risk of falling victim to fraud. A lot of landlords, especially in big cities, are afraid of long-term tenants, who do not pay the rent. Some of them move from one apartment to the next, without paying - the so-called "Mietnomaden". Under German law, getting rid of those tenants is very difficult - it takes a long time and the landlord has to pay - the costs of moving house, court etc.

For landlords, it is safer to rent out furnished flats for a limited period of time. The tenant gets a contract for the use of the apartment. He is not protected by the German law for tenants, which means, that he has to move out, if he does not pay the rent.
Crocodilian-Rooms in Berlin specializes in renting out furnished apartments. We check the tenants credit card, we ask for personal details and the reason for coming to Berlin.

The Difficulties of Giving Notice, if you have an unlimited Rental Contract
Landlords cannot simply order tenants out of their apartment, rather they must comply with a number of procedural requirements under German law. He has to explain the justification of the termination. German law accepts several grounds for termination. Either the landlords needs the apartment for himself or for his family. But only if the need is compelling and not only a mere wish to live there.. f  his A landlord who needs to use the rented premises for himself, his family, or a member of his household has valid grounds, but only if the need is compelling; a mere wish to live in the quarters is not sufficient. Termination is also legal if a landlord wishes to sell the property and can prove that selling the property "with tenants" will result in substantially less profit than selling it "without tenants."
Landlord can also terminate the contract, if the tenant violates the lease, does not pay the ent etc. But the tenant can still object to the termination and demand continuatin of the lease, if the termination will cause undue hardship to the tenant.

Even if the termination notice is valid and no hardship defense exists, the tenant will not be kicked out into the street right away. The landlord must obtain a court order before physically removing a tenant from the quarters, and must notify the tenant prior to the court hearing.
In any case, landlords risk to lose time, money and nerves, when dealing with a difficult tenant with a long-term contract.
